1. Grant of License

Subject to the terms below, Alaska Media Market (acting as authorized agent for the Photographer) grants the Licensee a non-exclusive, non-transferable, perpetual license to use the Image for personal, non-commercial purposes only.

2. Permitted Uses

  • Display in the Licensee's home, including printed wall art and personal photo books.

  • Personal social media posts and personal websites that are not monetized.
  • Personal gifts that are not offered for resale.
  • Personal screensavers and device wallpapers.

    • 3. Prohibited Uses

    The Licensee may NOT:

  • Use the Image in any business, marketing, advertising, or promotional context.
  • Resell, sublicense, redistribute, or transfer the Image or any derivative.
  • Use the Image on monetized social media accounts, paid advertising, or sponsored content.
  • Use the Image in connection with merchandise offered for sale.
  • Use the Image in any way that defames, harasses, or misrepresents any subject depicted.
  • Remove watermarks or claim authorship of the Image.

    • 4. Term

    This license is perpetual and begins on the Issued date. It terminates automatically if the Licensee breaches any term, in which case the Licensee must cease all use and destroy all copies.

    5. Ownership

    Copyright in the Image remains with the Photographer at all times. This license does not transfer ownership.

    6. Warranties and Disclaimer

    The Photographer warrants they own or have the rights to license the Image. THE IMAGE IS PROVIDED "AS IS." Alaska Media Market AND THE PHOTOGRAPHER DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED.

    7. Limitation of Liability

    In no event shall the Photographer or Alaska Media Market be liable for any indirect, incidental, or consequential damages. Total liability is limited to the amount paid for this license.

    8. Governing Law

    This agreement is governed by the laws of the State of Alaska, USA. Disputes shall be resolved in the state or federal courts located in Anchorage, Alaska.
